Terms Of Service
These Terms of Service ("Terms") constitute a legally binding agreement between JHosting, hereinafter referred to as "we," "us," or "our," and the customer, hereinafter referred to as "you," "your," or "the customer." By using our hosting services, you agree to comply with and be bound by these Terms, which include provisions such as not hosting illegal content, not sharing your account details, and not seeking refunds for credits. Please read these Terms carefully before proceeding.
- 1.1 Orders will be promptly delivered, unless there is insufficient stock available at the time of purchase.
- 1.2 JHosting will make reasonable efforts to maintain adequate stock levels at all times.
- 1.3 By placing an order for a server with JHosting, you automatically affirm and warrant that you are at least 18 years of age or older.
- 1.4 To order any of our hosting services, you must provide accurate and complete information during the ordering process.
- 1.5 You agree to pay all fees associated with the service you order promptly and in accordance with the pricing and payment terms set forth on our website.
- 1.6 We reserve the right to refuse or cancel any order for any reason, including but not limited to security concerns or violation of these Terms.
2. Game Server
- 2.1 If the consumer fails to renew the server, JHosting is granted the authority to terminate the server's operation.
- 2.2 In the event that the consumer does not renew the server, JHosting is authorized to delete all data associated with the server after a 5-day grace period.
- 2.3 Support for plugins, resources, and code is not guaranteed due to the complexity of these elements, and it may not always be available.
- 2.4 JHosting bears no responsibility for data loss. The customer is solely responsible for maintaining backups of their data.
- 2.5 Game server hosting is provided as-is, and we do not guarantee uninterrupted or error-free service. We are not responsible for any in-game issues, including but not limited to, game glitches, bugs, or connectivity problems.
- 2.6 You are solely responsible for configuring, managing, and maintaining your game server, including but not limited to, updating the game software and managing player accounts.
3. Virtual Private Servers
- 3.1 The customer is expressly prohibited from hosting illegal programs, content, or websites on JHosting servers.
- 3.2 The customer is expressly prohibited from sending spam or engaging in spam-related activities from their JHosting servers.
- 3.3 JHosting assumes no responsibility in the event of data loss. The customer is solely responsible for creating and maintaining backups of their data.
- 3.4 JHosting does not provide support for third-party applications; however, we may offer general guidance or direct you to appropriate resources when applicable.
- 3.5 JHosting reserves the right to suspend a server if any form of illegal activity is detected on that server.
- 3.6 Virtual Private Servers (VPS) are provided on a best-effort basis, and we do not guarantee the availability of specific resources or performance levels.
- 3.7 You are responsible for the configuration, management, and security of your VPS, including but not limited to, software updates, firewall settings, and data backups.
- 3.8 It is explicitly prohibited to engage in cryptocurrency mining activities on a VPS provided by JHosting.
- 4.1 The customer has multiple communication options to inquire about their service, including opening a ticket on our website, engaging in live-chat conversations, posing questions in our Discord server, or sending an email to [email protected].
- 4.2 JHosting's official (non-SLA) response time is set at 24 hours. However, it is acknowledged that in practice, responses may be substantially quicker.
- 4.3 JHosting exclusively offers support for services directly provided by JHosting.
- 4.4 JHosting does not extend support to third-party software or applications.
- 4.5 You agree to provide accurate and complete information when seeking support and to cooperate with our support team in resolving any issues.
- 5.1 We do not offer refunds for our hosting services. All payments are final.
- 5.2 In exceptional circumstances, where we may consider issuing a refund, it will be at our sole discretion.
6. Other obligations of the customer
- 6.1 The customer is expressly prohibited from hosting or running any websites or programs that are in violation of Dutch law. This includes but is not limited to engaging in DDoS attacks, hosting child pornography content, and hosting copyrighted content without authorization.
- 6.2 The customer is solely responsible for creating and maintaining backups of their own servers.
- 6.3 You are solely responsible for the content and data stored on our servers. We are not liable for any data loss, corruption, or unauthorized access to your content.
- 6.4 You agree to comply with all applicable laws and regulations while using our services, including but not limited to copyright, trademark, and privacy laws.
- 6.5 You confirm that all information provided to us during the ordering process, including personal information, is accurate, complete, and up-to-date.
7. Cancellation policy
- 7.1 Customers may initiate a cancellation request through their designated client panel, subject to the terms and conditions outlined herein.
- 7.2 Prior to the initiation of the cancellation process, it is imperative that all outstanding invoices be settled in full. We kindly request that customers ensure all financial obligations to JHosting are met. This includes, but is not limited to, the payment of any pending invoices, subscription fees, or outstanding balances.
- 7.3 Once all outstanding financial obligations have been met, the cancellation process will be promptly initiated by JHosting. Please allow a reasonable processing time for the completion of this procedure, during which time access to services may still be available.
- 7.4 After cancellation, customers are responsible for any outstanding obligations that may arise as a result of prior agreements, including but not limited to contractual commitments, warranties, or outstanding legal matters.
- 7.5 JHosting reserves the right to refuse a cancellation request if there are unresolved disputes or other pertinent reasons as deemed necessary by the company. In such cases, JHosting will communicate the reasons for refusal to the customer.
- 7.6 JHosting reserves the right to amend or modify this cancellation policy at any time without prior notice. Customers are encouraged to periodically review the cancellation policy for updates.
8. Other obligations of JHosting
- 8.1 JHosting explicitly disclaims any responsibility for the content that the customer hosts on our servers.
- 8.2 JHosting reserves the right to remove any illegal content or other illegal applications/scripts that are not permitted by law.
- 8.3 JHosting assumes no responsibility for data loss in any circumstance. The customer is solely responsible for data backup and protection.
- 8.4 We will make reasonable efforts to maintain the security and availability of our hosting services. However, we do not guarantee protection against all potential security threats, nor do we guarantee uninterrupted service.
- 8.5 We reserve the right to suspend or terminate your service at our discretion if you violate these Terms or engage in any illegal or harmful activities.
9. Force of the majority
- 9.1 None of the parties is obliged to fulfill any obligation if it is prevented from doing so due to force majeure. Force majeure means in any case: war (danger), riots, strikes, war, fire, water damage, flooding, atmospheric conditions, prolonged power outages, adjustments or maintenance to the telecommunications network and / or electricity network of others, cable breaks, attacks on a network / server including DDoS and DoS, disruptions in the networks important for JHosting, disruptions in communicative connections including telecommunication connections or prevention or refusal / prolonged absence of compliance by suppliers on whom JHosting depends on the performance of its work is.
- 10.1 In exchange for a €1 donation, you will receive 110 credits (equivalent to €1.10).
- 10.2 Donating credits to yourself is strictly prohibited.
- 10.3 Credits are exclusively valid for use on the JHosting website, specifically for purposes such as renewing your server, upgrading your server, or purchasing a new server.
- 10.4 Credits are non-refundable and cannot be exchanged for cash or any other form of compensation.
- 11.1 Sharing your account details with others is strictly prohibited.
- 11.2 In the event that you lose your account details, account restoration is contingent upon linking your Discord account to your JHosting account.
- 11.3 Credits are non-refundable and cannot be exchanged for cash or any other form of compensation.
- 11.4 You are responsible for maintaining the security of your account credentials and ensuring that they are not shared or disclosed to unauthorized parties.
- 11.5 We reserve the right to suspend or terminate your account for any violation of these Terms or if we suspect unauthorized use or fraudulent activity.
12. Opening hours
- A. JHosting is open every day from 09:30 AM to 08:30 PM excluding Sundays or holidays. on Sundays, JHosting is open from 10:30 AM to 8:30 PM. On all public holidays, JHosting uses the opening hours of Sundays unless otherwise stated on the website.
